Introduction
The action to click the icon “I confirm the order “ implies that the buyer has bought the presented merchandise and has accepted the present sales contract.
Any purchase on this website implies the full acceptance of the sales conditions defined hereafter. These sales conditions are subject to modifications at any time; the new sales conditions apply only to sales concluded after the modification.
In no case does the cancellation or the non-application of any of the general sales conditions imply the cancellation of the other general or specific conditions, all these remaining in full effect.
Article 1 Sales Object
The present contract is concluded between the company PlanetVision Sàrl and a consumer in the context of an electronic sale.
This being an electronic sales contract, concluded from a distant location through electronic means, the company PlanetVision Sarl does identify itself to the consumer.
The company PlanetVision Sarl has a capital of 12600 Euro and is headquartered
In L- 8537 Hostert , 13 , rue de la Montagne , Grand-Duchy of Luxembourg .

Article 2 Essential Characteristics of Articles on Sale
The company PlanetVision Sàrl manages a subsidiary company, specialized in electronic sales of contact lenses, solutions for contact lenses as well as general optical articles via their main internet address www.planetvision.eu
The key characteristics in regards to quality and quantities of the products on offer are listed with every product offered when presented on the site.
The products are available only to residents of the countries of the European Union, aged 18 or more.
Each person wishing to order products via the site declares to fully understand at least one of the languages proposed on the site and declares to have understood the general Sales Conditions in their entity. The languages proposed on the site are French, German and English.
The site is only handling renewal of contact lenses.
A regular follow-up by a contact lens specialist is mandatory.
Each person ordering contact lenses via this site certifies that the purchase covers the replacement of existing contact lenses only and that these have been before prescribed by an ophthalmologist/oculist (or an optician, provided he is licensed to prescribe contact lenses in the country of the buyer)
The customer declares that, through his order, he/she is regularly undergoing checks by a contact lens specialist and declares that he/she has been examined and has received a medical prescription from such a specialist, corresponding to the items ordered and this no more that 6 months ago.
Contact lenses have to be handled, cleaned and maintained according to the instructions of the ophthalmologist or the optician and the manufacturer.
In no case can the company PlanetVision Sàrl be held responsible for complications due to the wearing of contact lenses.
In case of burning, itching, pain, excessive tearing, sensation of foreign material in the eyes or if the vision becomes blurred or in case a halo is formed around objects, it is mandatory to immediately remove the contact lenses and consult a specialist.
The goods are delivered either by post or by a delivery service (see article 9: supply).
The photographs illustrating the offered products on the web-site have a purely indicative purpose. In no case can PlanetVision Sàrl be held responsible for eventual errors. Also, no responsibility is taken by PlanetVision Sàrl concerning eventual errors regarding the information about products described on this site, as long as such information is the one provided by the manufacturer.
Article 3 Engagement
The acceptation of the order is handled via recording of the information appearing on a screen page.
If the buyer clicks on the icon “I accept “ on one hand and “I confirm the order “ on the other hand , he/she is firmly bound to the purchase . The acceptance cannot be revoked anymore, except through application of the article “withdrawal delay “.
Indeed, the automatic registration systems installed at PlanetVision Sàrl are considered to be proof of conclusion of the sales contract.
Article 4 Nominative Information
During order treatment, nominative information relative to the consumer is collected. The consumer acknowledges being aware of this. Except for the execution of the payment process, this nominative information will not be forwarded by the company PlanetVision Sàrl to any third party (except by prior agreement of the customer or if forced to do so by law or by a competent official organism )
Notwithstanding can PlanetVision Sàrl not be held responsible for any loss the customer could suffer through unauthorized access by a third party during his/her access to the web-site and during the ordering or during any other process.
Customer data are eventually used for publicity or information mailing purposes exclusively generated by PlanetVision Sàrl .
The consumer has, as stipulated by the law, at any time upon simple demand, the right to access, modify or delete these data.
Article 5 Prices
Prices are expressed in Euro.
All prices are fully inclusive of all taxes.
Delivery costs will be added to the sales price.
The amount of delivery costs will be indicated during the order process.
Each parcel will have a detailed invoice included.
The company PlanetVision Sàrl reserves the right to change prices at any moment in time.
Prices are defined as the ones applicable during the ordering process.
Article 6 Order Confirmation
The customer will receive as soon as possible an order confirmation.
This confirmation is issued latest on the delivery day. The confirmation will be via electronic means (e-mail). It will summarize the essential characteristics of the goods, the price and the payment terms as well as the delivery terms.
The confirmation contents are stored by the company PlanetVision Sàrl .
They are considered to be proof of customer consent to the transaction and its date.
Article 7 Withdrawal Delay
The customer is entitled to a withdrawal delay of fourteen ( 14 ) days starting
at the reception of the ordered merchandise .
This withdrawal delay is extended to three month in case the company PlanetVision Sàrl has failed to send an order confirmation. However, in case the order confirmation is executed within the above said 3 month delay; the normal delay of fourteen days is valid again.
All returns have to be through an adequately stamped parcel to the address mentioned in article 1 of the general sales conditions (= returned goods service). The parcel will contain an explanatory note, the bank coordinates of the customer as well as a copy of the invoice.
Cancellation has to be through a registered letter with proof of reception.
The direct costs of the return are carried by the customer.
In case of an exercise of the withdrawal right, the company PlanetVision Sàrl
will reimburse to the customer the entire amount paid within a time frame of thirty ( 30 ) days maximum .
Reimbursement will be through bank draft.
No withdrawal will be accepted for sales of goods having their packing damaged or opened.
Article 8 Payment Terms
Payment of goods and services ordered is immediate by credit card ( Visa or MASTERCARD credit cards ) or by advance payment to the bank account of the company PlanetVision Sàrl ( see article 1 ) .
The company PlanetVision Sàrl reserves the right to cancel any order in case the data provided by the customer are incorrect , in case the customer’s ability to pay is not proven or for any other motive .
Article 9 Delivery
The company PlanetVision Sàrl provides the shortest delivery time possible.
In most cases, delivery will be between 2 to 4 days for products on stock .
Delivery times eventually indicated together with the products illustrated on the site are only indicative.
The company PlanetVision Sàrl will in all cases deliver the merchandise within thirty (30) days following the order.
In case the goods are not available, the customer will be informed in the shortest possible time frame and can subsequently ask for a reimbursement of the paid amount or for a substitute product.
The company PlanetVision Sàrl has no supply obligation in case of force majeure (like fire, floods, strike etc) or other reasons beyond its control.
Delivery will be to the customer’s home address. Delivery costs are paid for by the customer.
Travel risks of the ordered goods are carried by the customer. Upon merchandise reception, the customer will verify the general aspect of the goods. All complaints have to be forwarded to the delivery company within three (3) days following the delivery.
Data relevant to the delivery company are listed on the order form and the order confirmation.
In case of delivery through postal services, the company PlanetVision Sàrl can in no case be held responsible for delivery delays or product loss.
Article 10 Product Warranty
The company PlanetVision Sàrl guarantees that all products stem from official distributors or from the manufacturers themselves.
PlanetVision Sàrl not being the product manufacturer, only the product manufacturer’s responsibility can be claimed by the customer in case of damage supported by him/ her due to an eventual product fault.
The company PlanetVision Sàrl declines all responsibility in case of improper use of the supplied goods
Article 11 Transaction Safety
The company PlanetVision Sàrl declares to have installed all the required safety devices to provide safe transactions.
Electronic payments are handled through Pay@Cetrel ( www.cetrel.lu ) .
Card data are encoded in a secure Cetrel window and are not transmitted to the company PlanetVision Sàrl.
Article 12 Intellectual property
The Internet set of PlanetVision Sàrl and its content are protected by copyright. Any reproduction, even partial, is strictly prohibited except by written agreement from PlanetVision Sàrl.
Article 13 Litigation Process
In case of issues regarding the interpretation and the execution of the present contract, the parties agree that prior any legal action, they will try to find a mutually acceptable solution. Should this process fail, the court of the city of Luxembourg will be responsible to judge any litigation resulting from the present contract.
Article 14 Applicable Law
The parties agree that this contract is governed by Luxembourg law.
